Intellectual property infringement is the violation of a protected intellectual property right.
Intellectual property rights are infringed when a protected work is used, copied or exploited without having the proper permission from a person who owns those rights.
The inventor or creator has the right to litigate against infringers and stop their activity once he has registered his patent, trademark, or copyright.
Copyright is infringed if uses the whole or a considerable part of the work. An essential part of the work is any part that any person familiar with the work may independently identify as a part of that work.
Which actions are considered to be violations of law:
- copying,
- issuing copies,
- renting or lending,
- performing,
- showing,
- playing,
- communicating or adapting the copyright work.
But the copyright work may be used without an infringement if somebody uses ist for such purposes as:
- non-commercial research,
- private study,
- illustration for instruction
- criticism or review
- Other fair usage
Copyright Infringement in Armenia:
Use of the work is illegal if the copyright or associated rights of the holder have not been obtained beforehand.
Taking thoughts or excerpts from another’s work without their creative recycling, without mentioning the source and presenting it as a plagiarism is considered to be plagiarism.
A person who fails to comply with this Law is considered to be infringing the copyrights or related rights.
Liability for infringement of copyright or related rights is envisaged in the manner prescribed by law.
Do not violate the rights of others so as not to violate yours.
