Utility models protect new technical inventions and prevent the use of protected inventions without consents of the right holders.

Sometimes utility models name innovation patents or petty patents.

Utility model’s patronage conditions in Armenia

In every country conditions of utility models are different. In some countries, utility models can be applied for in the same fields of technologies as patents, and in other countries they include other fields.

In Armenia utility models cannot protect:

• technical solutions for biological material
• chemical or pharmaceutical materials or modalities as well as human and animal treatment modalities and etc..

The utility model license is valid 10 years from the date of submission of the application.

IP protection through utility model

As you know, utility models are available in Armenia.

Utility model protection means that the invention cannot be used, distributed, imported or sold by others without the utility model owner’s agreement. It has a territorial meaning. The right can be enforced only within the country in which a utility model is given.

In comparison with patents, utility model needs compliance with less stringent requirements (for example, lower level of inventive step), offers shorter term of protection and has a simple process. As it is designed primarily to respond to the needs of local innovators, the requirements, procedures and duration of protection are different in each country.

Remember – utility model systems are often used by local inventors.
